Terms of Service

These Terms of Service govern your use of the Sole Culture footwear store operated through savannajewels.co.za. By visiting the site or ordering shoes from us, you agree to these terms. References to “we”, “us” and “our” mean Sole Culture. Nothing in these terms excludes or limits rights that cannot lawfully be excluded under South African law.

1. Eligibility and acceptable use

You must be at least 18 years old or have the involvement and consent of a parent or legal guardian to place an order. You may not use the store for unlawful, fraudulent or abusive purposes, attempt to interfere with its security, or introduce malicious code.

2. Footwear information, fit and sizing

We take reasonable care to display each shoe's colour, material, construction, description and available sizes accurately. Fit can vary between styles and between different feet, so customers must review the size information on the relevant product page before ordering. A listed size does not guarantee a particular fit.

Screen settings, lighting, photography and manufacturing batches may cause minor colour or texture variations. Suede-like, cork-look, woven and other textured materials may show natural-looking variation between pairs. These minor variations are not necessarily defects. Product and size availability can change without notice.

3. Footwear use and care

Sole Culture shoes must be used for their intended casual-wear purpose and cared for according to any instructions supplied. Normal footbed impressions, outsole wear and creasing caused by use are not manufacturing defects. Damage caused by incorrect sizing, misuse, excessive water or heat, unsuitable cleaning products, alteration, repair or ordinary wear and tear is not treated as a defect, subject always to rights that cannot lawfully be excluded.

4. Prices and payment

Prices are displayed in South African rand unless stated otherwise. Applicable delivery charges are shown at checkout. You authorise the payment provider to charge the amount confirmed at checkout. We may correct obvious pricing or description errors before dispatch and will contact you if an affected order cannot be fulfilled as placed.

5. Orders

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, stock unavailability, obvious errors, misuse of promotions or delivery restrictions. If we cancel a paid order, we will provide the refund required by law.

6. Shipping

Our estimated delivery timeframe and fulfilment arrangements are described in our Shipping Policy, which forms part of these terms. Some products may be fulfilled by third-party partners and separate parcels may be used.

7. Exchanges, returns and refunds

Our voluntary exchange rules and statutory-return process are described in our Refund and Exchange Policy, which forms part of these terms. For ordinary change-of-mind or sizing requests, our commercial policy is exchange-only, subject always to non-excludable rights under applicable law.

8. Intellectual property

The store design, branding, written content, graphics and other materials owned by or licensed to us are protected by applicable intellectual-property laws. You may use the site for personal shopping purposes only and may not reproduce, distribute or commercially exploit our materials without permission.

9. Third-party services and links

The store may rely on Shopify, payment providers, couriers, fulfilment partners and other third parties. Their services may be governed by their own terms and privacy practices. We are not responsible for third-party websites that we do not control.

10. Reviews and submissions

If you submit a review, photograph or other content, you confirm that you have the right to submit it and that it is not unlawful, misleading, defamatory or infringing. You grant us a non-exclusive, worldwide, royalty-free licence to use that content for operating and promoting the store, subject to applicable privacy law.

11. Disclaimers and liability

We do not guarantee that the site will always be uninterrupted or error-free. To the fullest extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable. Our liability is not excluded or limited where doing so would be unlawful, including for fraud, gross negligence or non-excludable consumer rights.

12. Privacy

Personal information is processed in accordance with our published Privacy Policy and applicable data-protection law.

13. Changes to these terms

We may update these terms by publishing a revised version on the store. Changes apply prospectively from their stated effective date and do not remove rights already accrued under an accepted order.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. Nothing in this clause prevents a consumer from approaching a competent consumer-protection body, ombud or court where permitted by law.

15. Severability

If any provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
